Refund Policy

Definitions

1.1 The Company

The Company: XYO, operating under the business name The Belgium DJ School, with company number 0748.753.094, located at Heidebloemstraat 10, 3500 Hasselt, Belgium, and email address [email protected] .

1.2 The DJ Participant-Consumer

The DJ Participant-Consumer: any DJ participant, a natural person who usually resides in Belgium and acts primarily for private purposes. The Company has a B2C relationship with this DJ participant.

1.3 The DJ Participant-Company

The DJ Participant-Company: any DJ participant who independently engages in professional activity, any DJ participant as a legal entity, or any other DJ participant as an organization without legal personality. The Company has a B2B relationship with this DJ participant. When purchasing the Master DJ course package, the DJ participant is considered to be in the role of a DJ Participant-Company.

1.4 The DJ Participant

The DJ Participant: both the DJ Participant-Consumer and the DJ Participant-Company.

2. Refund and Cancellation Policy

2.1 Refund Eligibility

Refunds are only applicable in specific cases outlined in this policy. All refund requests must be submitted in writing via email to [email protected] or use our contact form.

Any trial lesson or course package purchased is non-refundable once the first session has been attended. Refunds before the first session may be granted at the sole discretion of The Company.

In cases where unforeseen circumstances (such as illness or force majeure) prevent the DJ Student from attending, rescheduling options may be offered instead of a refund.

3. Price Adjustments

3.1 Pricing Adjustments Policy

The Company reserves the right to adjust pricing due to changes in operational costs, including but not limited to: supplier fees, taxes, and wage adjustments. Any price changes will be communicated at least thirty (30) days in advance.

If a DJ Student disagrees with a price adjustment, they may cancel their remaining sessions without penalty before the new price takes effect.

4. Service Delivery and Non-Attendance

4.1 Service Usage & Non-Attendance

Services must be used within six (6) months of purchase. Unused services after this period are non-refundable.

The Company only provides services once full payment has been received. Failure to attend a booked session without prior notice will result in the forfeiture of that session without a refund.

If The Company needs to cancel a session due to unforeseen circumstances, the DJ Student will be offered a reschedule or a refund for that specific session.

5. Price and Cost Determination

The prices applicable to the services are those that are listed on the website at the time of the order or those announced in a quotation. The prices are determined per trial lesson or course package and are expressed in euros, inclusive of VAT.

The Company expressly reserves the right to unilaterally change the price of its services if, after the conclusion of this agreement, one or more objective factors for price determination change due to foreseeable or unforeseeable circumstances, including but not limited to the prices of: raw materials; supplier services; energy; levies and taxes imposed by domestic or foreign governments; and labor costs.

The Company will notify the DJ Student of the new service price in writing by registered letter at least thirty (30) days before it takes effect. If the DJ Student does not accept the new price, they may terminate the agreement in writing and without giving a reason by registered letter. If the Company does not receive the termination of the agreement by the time the new price takes effect, the DJ Student will be deemed to have accepted the new price.

6. Service Delivery and Force Majeure

  • Service Usage: Services must be used within six (6) months; otherwise, the right to the remaining services expires.
  • Payment Policy: The Company provides services only when full payment has been received.
  • Enrollment Requirement: All courses, workshops, trainings, or educational programs are subject to sufficient enrollment.
  • Location Change: Belgium DJ School reserves the right to change the location if necessary.
  • Liability: The Company is committed to best efforts but is not liable for any damages, direct or indirect, except in cases of gross negligence or intent.
  • Indirect Damages: The Company cannot be held liable for indirect damages such as loss of income, loss of contracts, capital costs, limited returns, or other consequential losses.
  • Liability Cap: The Company’s liability is limited to the invoice value of the provided services.
  • Force Majeure: The DJ Student may not claim compensation for non-performance due to force majeure, including but not limited to illness, death, extreme weather, or natural phenomena.
  • Subscription Cancellation: A notice period of 1 month must be respected for subscription cancellations, starting from the first day of the following month.

7. Obligations

The DJ Student must ensure that the services can be provided by the Company in a normal manner at the agreed location and time, including being present at least ten (10) minutes before the scheduled lesson time. If this is not met, the DJ Student is required to compensate the Company for all damages, including waiting time, storage fees, and studio rental costs. Lesson times are always booked for one hour and cannot be extended. In case of late arrival, no refund (in full or in part) will be provided.

The DJ Student must provide clothing that may get soiled or damaged. The Company cannot be held liable for soiling or damage to personal property, such as clothing.

The DJ Student is responsible for purchasing their own music and must obtain a UNISONO DJ license before the lessons or performances. The Company does not participate in the refund of this DJ license and cannot be held accountable for the failure to comply with these obligations. The Company will not intervene in the refund of any compensation, nor in the cost of verification and transportation for such checks.

The DJ Student is prohibited from using alcohol or any other intoxicating substances. The Company is not liable for damages the DJ Student incurs due to the use of alcohol or drugs, nor can the Company be held responsible for any damage caused or suffered by the DJ Student under the influence of alcohol or drugs.

The DJ Student is responsible for any damage caused to teaching materials or third parties and agrees to indemnify the Company for such damage.

8. Complaints and Disputes

Dispute Resolution

Any complaint regarding refunds must be submitted in writing within seven (7) days of the disputed event. Complaints received after this period will not be considered.

If a refund is granted, it will be processed within fourteen (14) days using the original payment method.
